How to Avoid a DUI Conviction

The easiest thing to do to avoid a DUI conviction is to not drink and drive. It is a simple suggestion, and it is heard all of the time.  But, in an imperfect world it doesn’t always happen. So if it does happen, what can you do to prevent it from leading to a conviction ? After you have been pulled over, failed a sobriety test and you are being taken into custody, what happens next is what can effect whether or not you’ll be convicted.  Here are tips to avoid this from happening.

Don’t Admit Anything

This may be extremely difficult to do when you are intoxicated. Everything you say can be used against you.  You don’t have to talk at all until you have representation.  If you were involved in an accident, the same goes. Don’t try and talk your way out of it. Most of the time while you are trying to talk your way out of it you may be providing more information that incriminates you.

Get a Lawyer

It can be intimidating having to hire a DUI lawyer . Don’t just simply go to the phone book or listen to the radio for help in finding the right lawyer. You want a lawyer that is experienced and persistent in taking care of your DUI case. Ask around, to friends, family and co-workers (the ones you trust).  Know the Law

Anything you say may be used against you.  You have the right to a blood test to preserve a sample for later analysis.  You also need to be properly informed of any implied consent before tests, such as the breathalyzer or blood tests. Once is Enough

If you were fortunate enough not to be convicted the first time arrested, don’t be a re-offender. Many states have further laws for reoffenders; there will be more consequences if you are arrested again.

The easiest way to do this is to not drink, but when this isn’t in the plans be sure to make arrangements for designated drivers, cabs or drink at an establishment that offers shuttle services.  When consuming alcohol know how the alcohol contents and take into consideration your weight before over drinking when you plan on driving. With proper planning there isn’t a need to avoid a conviction.
